If I am then seen by a passer by am I guilty of indecent exposure or are they guilty of voyeurism!?

If I am then seen by a passerby am I guilty of indecent exposure or are they guilty of voyeurism - please note this is a hypothetical question and I don't in fact walk around my house naked!!

An elderly lady called the police to report her neighbor was exposing himself to her through his window,that every time she went to the bathroom she could see him walking around naked.
so the cops come, and she takes them to the bathroom,and the lead cop looks at the window and says "lady i cant see anything ,the window is too far up" and the lady says"oh you have to stand on the toilet!" HA HA
Sorry but your question reminded me of this joke i heard, and i could,nt resist.
but seriously now .If you are walking around naked in your own home with the curtains open and anyone who walks by can see you, then you are commitng an offence and can be charged with exposure.
however if your curtains are closed and no one can see you ,but someone does because they were, say, up against your window peeking through a crack in the curtain,then it,s obvious who is the offender there.
blinds with heavy curtains work best! LOL

according to english law, if you are inside your house, then it's their own fault for looking in, but they aren't guilty of voyerism, if you've done nothign to activley prevent them from looking.

now, if you opened the window you were standing at, then it becomes indecent exposure, same as in your garden, it's indecent exposure unless you are within you're own four walls ( and there aren't any windows open, except for the ones at the top of the glass).

you could have rampant sex in your front room all day, pressed up against a window.. technically you haven't commited any criminal offense, but you may be disturbing the peace, causing civil unrest which gives rise to action against anti social behaviour. and you're neighbours won't like you very much, particularly if there are impressionable children about.

not sure about american law though, thats a different kettle of fish.

I walk around in m house naked all the time. Nobody on the outside would ever see me though because I am very careful to pull the curtains closed.
My exhibitionism is only for my husband!
So to answer your question, You would be committing the offense of perversion because you left your curtains open for innocent pedestrians to look upon your naked body on purpose.

If you are blatantly standing naked in front of an open window, then yes you are committing a crime. The best thing you can do is to shut your blinds. Lord help you if your doing that and a kid sees you, because then you go on the sex offenders list.

If you want to run around naked in your house, that is your business. But close the shades or curtains. If you are exposing yourself to people on the outside,yes you are commiting a crime and you can go to jail. And you would be labeled as a sex offender. You don't want to know what the inmates do to sex offenders. Especially if it involves children.

I walk around naked all the time, but I shut the window blinds.
It's geat being comfortable, but why show the goods off to absolutely EVERYONE?

You have your right to be bare within your own household but still it is better to keep your privates to yourself you know.

NO, it isn't considered an offense.....yet.

On the other hand,the certain passer by could be the one guilty of being a witness to the scene.

Well, you really have to make sure you can't be seen. You never know what sort of nutters are out there.

It is acceptable to open the door on cold callers and Jehovah's Witnesses.

It would depend on whether you are aware of being watched.
If you are, it is an offence in England, but not in Scotland or in the rest of the EU.
