Today my nephew was arrested. We live in Texas. Apparently he was involved in an altercation at his high school. I don't know specifics yet but he says he and another child was play (as boys do) and he had a razor blade and was waiving it at the other boy and incidently cut him on his hand (just a scratch).These are not argued by either child but the boys parents were not amused and called the police. He was arrested. What should his parents expect as far as his punishment. He has never been in trouble before. Gets good grades and plays football for his school the other student was his teammate. This is serious so please no sarcasm.

Let me add me and my family take this situation as a joke. He should and will receive punishment. I was just making a point that he is a good kid that made a horrible decision to pick up a razor and be so nieve and STUPID as to pull it out even if he meant it as a joke, bcuz it's just not funny. He just turned 15. He doesn't carry blades around in his pocket. We are a black family but that doesn't mean he is a gang banger. I simply want to know from a LEGAL stand point what we are facing. Thanks in advance for all the LEGAL and not parenting advice.

What your nephew did by the letter of the law is aggravated assault with a deadly weapon; dependent on the other boys age either he or his parents have the final say on wether or not charges proceed to the D.A.'s office and to prosecution. If the charges followed through he's looking at a second degree felony 5-20 years and a 10,000 $ fine. However, if the judge considers his grades and etc. he may offer a deferred adjudication. If this is offered I would advise he take it. The adjudication is a plea of "guilty" by letter of the law, but if he is a good kid and completes the adjudication (which is probation) without any incidents against him the charge would be erased from his criminal history. Charges that would revoke the probation wouldnt be traffic tickets or anything small like that but failing to report to the probation office, possessing any type of narcotic, or another assault. If he's a good kid like you say then he would have no problem.

Texas has a boot camp for juveniles, It could go either way depending on the judge and the other parents input. Most schools have a zero tolerance for weapons at school and assaults. A razor blade is a weapon and even a minor cut is still an assault.
My advise is to get a good lawyer so nothing sneaks up on you or blind sides you. The justice system can be brutal so, its always best to be prepared.

Sorry to say but it sounds like you don't know the whole story nor do you know what he really does at school or outside his home. He could be hiding the fact that he's in a gang. If he was such a well behaved kid, he would have never been carrying a razor blade in school.
"Gets good grades and plays football for his school"
That's what the all say about their family members to try and make them look good and hide the real truth.
This year razor blades then he graduates and next year it will be switchblades and so on until he ends up in jail..
Open your eyes and face the facts, your nephew is no angel!

He can be expelled for having a weapon at school. Expulsion may ruin his position on the football team. If the events happened off of school property, he might be lucky and not have to worry about that.
As for his arrest, this sounds like a minor matter and considering he sounds like a good kid, bail should be no problem. Get a good lawyer and hope for the best.
As far as what to do, have his parents kick his butt for being stupid and rough-housing with a blade in his hand. Kick his butt twice if he takes anything that can be considered a weapon to school again-even if he leaves it in the car during class.

Having a razor blade on school grounds calls for mandatory expelling of the kid. It doesn't sound like he was horsing around if he pulled out a blade. If he gets fair treatment, he should get probation for a first offense. There are other factors. In Texas if he is black the punishment will be more severe.

To put this as seriously as I can without sarcasm. Putting your nephews good grades and the fact that he's never been in trouble before aside, he still committed assault and with a weapon none the less. Razor blades just aren't something you play with. Why was he carrying one in the first place? How old is this kid? Who made the determination that the cut on the hand was just a scratch? Incidentally I'm not amused either.

I don't think you have the whole story. And, by the way, while "boys will be boys", no "boys" I know would a) carry a razor blade to school or b) pull it out on another person, horsing around or not.
Do you understand that this is not acceptable? Do you understand that most high school kids who get good grades, play sports and are trouble-free don't carry and use razor blades?

Hats off to All who answered this question .You All make excellent points in reguards to info provided.as a distant family member she/he 'May know more then the Parents 'do concerning whats going on in this Young Mans life[he is Not a kid!] He is in High School and Knows What IS Right&Wrong for anyone on the block wether they be in school or not.Ask people Who have been in jail/juvie or watch Tv shows about prison and what so called "Shanks" can do=THEY KILL~MAME 4 LiFE.I don,t think these two team mates were trying to become blood brothers ..Ya' Know what I,m saying.Something is not known here or is not being mentioned.
Whatever the case may be ,I Pray All concerned will get thru this -bad life lesson -and will move on to a brighter future with no more of the B.S mentioned. luv to all D

Assault,with intention(he had the blade in his possesion,and there had better be a good excuse as of why?)
He's probably gonna get expelled from that school since there is usaully zero tolerance.
He may get to be admitted back to a regular school,but not the one of the incident
My marginal legal advice: get a lawyer,protect his rights,and minimize the damage as to not create more problems in the future from what comes of this

hard to say. it all depends. if hes charged with aggravated assualt, he could get 1+ in jail. The fact that he even had a razor blade on him isn't going to benefit him. And in my opinion, when a kid takes out a razor blade its not considered "horsing around" anymore.
