I haven't worked for the entire year due to a medical condition. I have lived with my boyfriend for 5 years, and this year he has been my sole means of support. Also, I've been paying off back taxes and have a small balance still due...in the event he can claim me, would he then become responsible for my taxes?

Sounds like he could, provided you are a U.S. citizen. The IRS guidelines are deceiving because you need to be a "qualified relative" or "qualified child". Isn't a child a relative? See what I mean. Well #2 below explains, how someone non-related (or distantly related) can qualify. Basically living in the same household for the whole year, provided it doesn't violate local law. (Over three unrelated people in same household is a classic example).

1) The person cannot be your qualifying child or the qualifying child of anyone else.

2) The person either (a) must be related to you in one of the ways listed under Relatives who do not have to live with you, or (b) must live with you all year as a member of your household (and your relationship must not violate local law).

3) The person's gross income for the year must be less than $3,300. 3

4) You must provide more than half of the person's total support for the year. 4

Jim is correct; there are situations where you can be claimed by him as a dependent. Barbara is also correct; the nature of the relationship cannot violate local law. There are circumstances that allow people to claim non-relatives as dependents when they live under the same roof & they provide all of that person's maintenance and the dependent's income is less than $3300. Claiming you as a dependent does not make him personally responsible for your back taxes until you make the union legal by marriage.

You said you lived with him all year, he provided over half of your support, and you didn't have gross income over $3300 - so yes, he could claim you as a dependent. He wouldn't become responsible for any back taxes you have.

If your state considers living together a "crime" (it's technically illegal), then no. In MI it is on the books that it's against the law for two people to cohabitate without being married, although it's not enforced. Concerning your back taxes, I don't know.

No, girl/boyfriends do not qualify for dependent status, even if one provides the sole support for the other. To get an exemption for you, the two of you would either have to be related or married (hopefully not both, lol).

No, you have to be married. You can't claim friends.
