If your husband didn't live in your home at any time during the second half of the year, you provided more than half of the cost of keeping up the home, and you had a dependent child living with you, then you were allowed to file as head of household. That rule is in effect now, and was in effect for th 2004 tax year also. If all these weren't the case, then you weren't allowed to file as head of household and would have had to file as married filing separately. This should have been resolved by now - it's not real complicated - if you filed on time - maybe not if you just filed recently. In any case, once your correct filing status is determined, you should be able to get your refund if one is due.
If this just isn't happening, ask to talk to a Taxpayer Advocate - maybe they can get things moving.

Where you separated in 2004?
Did you live with your husband at all after June 30?
Did you pay more than half the cost of maintaining a home for your child?
You can file as Head of Household if the above conditions are true. Its possible that your husband has also filed as Head of Household. Or maybe you both claimed the same exemptions.

Since you were still married, you were not allowed to file as HofH. You must amend your return and you must file as Married - joint or separate.
