My husband and I file joint married for Federal Taxes. For state taxes I am an Illinois resident and my husband is a Florida resident and he is exempt because he is in the military. Would I file married single for state. I used Turbo tax to do my taxes and it included my husbands income and says that I owe. His income should not be included.

Is your husband stationed in Florida? The military tax payer has a "State of Record." This is where he maintains a home.

If your main home is in Illinois and that is where he enlisted, then that is State of Record and he has to file state income tax there.

If Florida is his State of Record, then He wouldn't need to file a State Return.

You will file a Joint Federal return and Married Filing Separate on Illinois if Florida is his State of Record or Married filing Joint if Illinois is his State of Record.

Even if Florida is his State of Record, you could file as Joint Illinois return, but you will have to include his military income.

Your husband isn't exempt in FL because he's in the military -Florida doesn't HAVE a state income tax.
