I suppose you are saying that the tax refund check belongs to your brother, but it has your name on it as executor/caretaker/ legal guardian? If it legally belongs to your brother, then you need to have him sign the back of the check (or if he can't sign, then the person who has assigned legal representation of him can sign for him), then deposit into his account for him. Even if you are not legally bound to him, as a good brother, get the check properly signed over and deposit it into one of his accounts (savings is best, or whichever he prefers). If he does not have a savings account set up, perhaps you can do that for him?

Let's say you do this and the bank fails to notice the name is NOT the one on the account...and then your brother refuses to give you the money. Neither the bank nor the IRS won't help you get the money back as they followed your instructions. If the bank notices and bounces the refund back to the IRS, it will add 3-6 weeks to getting the check by mail.

I believe you need to have your brother sign the back of the check 'Pay to the order of & then put your name' then he needs to sign it. It would be best if you contact a bank in your area though so they can advise you.
