We recently found out there was a judgement against us for a debt that we actually disputed and somehow they filed it is small claims, it was put before a judge who made a judgement against us for not responding, even though we were never aware that there was even a case brought against us.

Go to the link I've provided and read the rules of service for your state.

Go to your county court clerk and request a full copy of the file - "including the service papers"

Carefully read the service papers to see what how the service was done and what the process server states.

If you were not properly served according to your states rules of service, file a motion to vacate the judgment for improper service.

If you have any problems in reading the material, writing up the motion etc, you might check with a lawyer.

You may be the victim of sewer service - it does happen quite often

The person that "served" you most likely just left the paperwork somewhere and said that they gave it to you.

This happens all of the time believe it or not.

The thing you need to worry about is that a judgment has been issued. This means that your wages can be garnished, your bank accounts can be attached and any property you own can have liens filed on it.

Contact the company A.S.A.P. and work something out before this becomes a real mess.
