Is their an attorney who represents independent insurance agents in Austin, Texas? WE are having trouble locating an attorney that protects the rights and laws of an Insurance Agent. My husband and I work in the 403(b) market, assisting educators with their retirement. I would like to talk with an attorney and may need legal representation. We are victims of an individual agent and a TPA who have slandered us. As a result we have lost a huge portion of our business due to their unethical conduct. It will also harm us financially in the future. Their slanderous and immoral actions have blocked us continuing to do business.

I don't think the problem is that you can't find an Attorney who will represent independent insurance agents, but rather that you can't find an attorney who feels confident that he can prove "slanderour and immoral actions" against the TPA.

Keep looking, and I wish you well.

No, each agency usually has their own, and most don't even keep an attorney on retainer.

Slander is EXTREMELY difficult to prove. DAMAGES from slander are even harder - especially if they are offering their HONEST, professional opinion. If they don't like your pick of investments, or they have "better" alternatives, that's not slander, and it's not immoral, either.

I would start by contacting the attorney for some of the schools you work with - I'd be very surprised if you can't get one of those firms to do the work for you. Expect the going rate on this to be about $250 an hour, with $10,000 retainer. If you don't want to pay, well, the lawyers won't work for free.

CALL the bar association and explain your problem. They will direct you to someone who can help.
