I took a drug screen at my probation office, and it came up "positive", i havent smoked in at least 2 years. It had one bar full and the second bar was faded alittle bit. what does that mean? I heard that it was inconclusive. But he gave me a positive reading.
After I left the probation office, I went to the hospital and took a drug screen there and came up negative for THC, cocaine, I had no drugs in my system at all.
I called my P.O the next Thursday when i was supposed to check in with him and told him that i came up negative at the hospital..He told me it didn't matter, are they allowed to do that?
My probation Officer is black, and I'm white, could he be racist? or trying to set me up?

The strips they dip in the urnine don't determine the official results. Since you came back positive on the test strip there is an indication that you may have smoked marijuana. The remainder of your urine sample will be sent to a lab for official testing. If it comes back positive again then you have been tokin. And no he's not racist. That only works if he had been white and you black. The other way around won't ever cut it.

If the person who was reading the test results said that they were inconclusive, your PO should have never put down that you were hot. Faulty test strips are common. I would have demanded that I was given a retest the second that I found out it showed hot. Get the results from the hospital and tell your PO you want this to go to court if any negative action is to be taken against you.

These instant read test strips do provide false positive results. As some of the other contributors indicated, your sample should be confirmed - through GC/MS (gas chromatography/mass spectrometry)- and if you haven't used any illicit drugs, the sample should be returned negative.
There are numerous OTC drugs and prescription drugs which will provide false positives for illicit drugs, make sure you advise of all the medications you have been taking for the week prior to submission of the sample.

Awhile ago,we hired a driver. He was sent for a drug test and failed. He called, denied using drugs, and he sounded so sincere I sent him for a retest. Again, he failed.
He called and I told him.Again, he denied using drugs. I told him, you HAVE to be taking something. One,maybe, but you flunked 2!. he said, all I'm doing is taking xxxx for my sinuses.(some over the counter cough syrup.)
My reaction,WHY DIDN"T YOU SAY SO!
I called theVP,and he agreed to a third test. But it had to be in a lab in Philadelphia, and 2 people had to witness him peeing in a bottle. And he had to take the meds which he was taking with him.
He passed, and we put him to work.
I believe you. There has to bean appeal process. Good luck.
PS Were you taking an over the counter (or legit prescription drug) at the time of the first testing??

If you went immediatly to the hospital after you did his test, keep your results. They are time and date stamped, and a judge will see you went immediatly to the hospital because you KNEW you were clean.

They can do whatever they want. Truth doesn't matter. If they have a test that says you failed, them you failed. PO, Judges and especially Cops are a big problem. They all just assume you are lying and are trying to screw you over. You are freight to them and they get paid / promoted for charging people with stuff.

You may want to get a hair follicle test. If you are telling the truth, then there should be no problem. You're PO may agree to that.

Documentation is everything. Keep everything. If you went to the hospital, they will have the records. Get copies and appeal it.
