My mom is looking to sue for back child support, but some people say it is too late. Others say there is no time limit.

This is one of those questions that has some variation from state to state. All of the previous answerers were probably right for their state. In my state, you have 1 year after the child turns 18 or graduates from high school--whichever occurs last. The parent loses the right to sue for back support at that time. However, also in my state, the child has 3 years to sue after age 18. My state bar office would answer this question for you for free--so see if your state bar has a similar service. I also think a family law attorney would answer this question for free if you called him/her. You really need to say what state you live in or check with a local attorney. I've seen similar questions here before and its clearly different from state to state.

Urgh! No (and sorry to the lawyer above me)--I think everyone missed the question. Current support runs until the child turns 18. UNPAID child support is still due to the custodial parent--time limits vary from state to state. In WI the CSA can enforce for what is due for 20 years past emancipation! Don't hire an attorney--call your local child support agency (where the order is registered) and find out! Too many people think when the child(ren) are 18 there is nothing they can do to collect the debt that is due and never persue it. Have your mom call!!!

In Cali the parent has to sue for it before the child is 18.
After that, the child has the right to file up to the age of 23.

No time limit is right, but Mom needs to do it before the child is 18 yrs old or 22 if still in school or college.

That could vary from one state to the other. Your best bet is to check with Dept. Health & Human Services. They will tell you what you can get and help you locate missing parent if need be.

My wife's ex owes about $45,000 in arrears. Her daughter is 19 years old but the back payments will go on until he pays it off or is disabled or dies.

did you know that you can also file for an extension so that they will pay child support until the child is 21, if you file for the college papers

ask about it
