Smokers have no more rights. In my state, you can be stopped by the police for smoking in your car. You'll then be given a ticket if they find a child 6 or under, or 60 pounds or under in your car.

I completely agree with the smoking bans. I'm an ex-smoker too, and enjoyed having a cigarette while sitting in a bar having a beer (back when it was still allowed). But knowing the health hazards with smoking, why should we force the employees of these different restaurants, bars, etc. to be subjected to second-hand smoke and potentially develop health problems? It's not fair to them. If I was a smoker today, I would prefer to step outside in the bitter cold or nasty weather than have my smoke negatively affect a non-smoker. If I want to smoke indoors, I'll do it in my own home.

We have no more rights - we are the lepers of society now - we are "unclean". We kill other people with our evil second hand smoke and women gather their children and run when we draw near.
I feel your pain - but you'd better get used to being discriminated against as a smoker - it's only gonna get worse.
I think all smokers should quit at the same time -the world would fall apart without the RIDICULOUS amount of money we pay in cigarette taxes!

private companies can completely disallow smoking even out of the workplace. It has been upheld in court, a company implemented a no smoking policy with a long period for smokers to quit smoking or find another job and if they hadn't quit they would be fired. This was a smoking ban were employees couldn't smoke at all. Anyway, a few months later 2 employees where terminated for smoking even though it wasn't even near the place of employment.

It's legal to ban smoking in the workplace, at least where I live.
Smoking is a voluntary behavior, not a disability, race, creed, etc., so I'm not sure what rights smokers have.
I mean voluntary in a legalistic sense. Smokers are not being discriminated against on the basis of color, gender, or disability. We all know that nicotine is addictive, but AFAIK a smoker is not considered to have a legal disability just by smoking. It's something that a person *does*, not something that a person *is*.
But I'd be really interested in knowing if employers can legally refuse to hire smokers in the US.

you have the right to smoke outside.
This is so you don't infringe on someones right not to breath smoke. That's about it.
As for changing the hiring practise, that is discrimination and if proved, the company will pay a high price.
Now for the liberal Democrat, I'm not sure where you think you can say things like that and not be punished. You are just upsetting people for no reason. The person who asked this did nothing to you. Democrats are what is wrong with america.
How dare you say somene should be charged with murder for asking a question to clarify an issue. Shame on you

This morning I paid a ticket for my 18 yr old son.
He's a high school senior and he was stopped and ticketed because he had a minor in his car who had cigarettes on him. The ticket was $180 dollars. I'm not condoning smoking, but my son doesn't even smoke. Why should he have to pay for giving a smoking kid a ride?
It's getting kinda crazy. Make it totally illegal or stop the nonsense.

It's like prohibition, right?. Listen, stop smoking. I did and it's been over a year. I even got promoted. Ask your doc about CHANTIX. (sounds like a commercial right?) But seriously, I smoked for over 15yrs. I stopped cold w/ no fits no relapse. cost me about 35.00 per month w/ insurance.

Pretty much none regards the ban on smoking at work. I don't see how they can discriminate against you for something legal that you do in your free time though. You should see a lawyer.

For years, we non-smokers have had to put up with breathing the filth that the smokers put into the air. So stop whining and suck up the clean air. We have had to put up with only getting our allowed lunch and break periods, while watching smokers take multiple breaks during the day. So just deal with getting the same now.
