It depends. You can easily sue, but you'll HAVE to prove that it was the doctor's fault.
Did you go to therapy and DO the exercise? Have you been overusing your knee?
It's more than "I'm in pain and you screwed up." It may be more like "I'm in pain and I need help."

It is called malpractice and yes you can sue the doctor and the hospital.
However, you have to prove that the condition you are currently in is one that was caused by an error made on the part of the hospital, its staff or the doctor. I suffer from chronic pain so I know a little about pain issues. Knees are also very hard to repair. Having a life time of pain after the operation is a known complication and you probably signed a form saying that you accepted the risk of this outcome.
Another words YOU CAN'T SUE unless an error was made in the operation.

The Weas said it all!!!!!!!! However, if you can truely prove the the pain is a direct cause of what the surgeon did/didn't do then yes, you can sue. It will be difficult to prove though. See another EXPERT in the type of surgery you had and get his/her professional opionion on what is the reason for the continued pain. Seriously though listen to the Weas and think about others who have died (a 12 yr.old African American boy near the DC area) because he didn't want to complain about his tooth pain to his uninsured mother because his brother also had some health issues. The result was death that an $80.00 tooth extraction could have cured. How unbeliveable and disgusting that this has to happen anywhere but especially in our country.REALLY think 1st and good luck.

Depends on the situation. First get an attorney. Second, get all of your records together of what you have been through. Also make sure you categorize any lost wages or lost job opportunities. Third HURRY!!!!! In most states there is a one year statute of limitations on civil suits. Better get your complaint filed. Make sure you tell your attorney that. Sorry about the knee.

Was the doctor negligent? And ask yourself why you are suing. Is it for a get rich quick deal? If so, no you shouldn't. It just contributes more to the reason why people are paying too much for insurance and why some people don't have it at all.
