You have mother or fatherly rights unless you are considered unfit you guys need to work out vistitation. Kinda of need more details on this one are you male or female unfornuately it makes a big difference.

I also live in Indiana. My ex whom i have a daughter with took her without my consent . I found out that i have parental rights and took him to court. If these are children you two have together you need to hire a lawyer and fast. Seeing as how you two were never married, the court will decide who is the best parent for the children to live with. the other will be awarded visitation and ordered to pay child support, unless there is a reason to say one of you is unfit to do this and have visitation.

That depends on the reasons behind your 'mates' leaving. If they get custody of your 2 children, then you have the right to pay child support and get visitation. I don't think Indiana is a common law state, but if it was, it would have to be 7 years before you could get anything from them money wise.

You have more rights to the children then he does since you were the bearer of the children and he was only the sperm donor. Since he took the children and he did not marry you he has no rights to those children. Call the police and have him arrested for kidnapping. It does not matter how long you were living together common law is ten years and not five. So get your Children back ASAP. He has no right to them.

My X wouldn't return my child to me (they're in IN). The police said I needed to talk to the judge and they wouldn't do anything at that point. Find a good attorney and find out your rights. check the IN Bar Association website for a lawyer near you. You do have rights as a parent- just as much as your previous mate.

are they children you both share? then yes you have the right to seek custody or visitation. If it is your mates children but you raised them as your own you may have parenting rights as well. the best thing you can do is seek an attorney alot of them well do free consultation. or if you go through leagal aid they can help.

You can press charges of parental kidnapping to avoid custody hearings against him. The custody hearing part will hold more weight in the charges than simple kidnappingand authorities are more willing to help. Good luck

You have rights as the children's mother...but no rights as a deserted spouse, since you apparently never bothered to get married.

yes, if you are the mother/father or legal guardian you have rights to see your children. Go seek the help of a lawyer, even if it costs you it will be money well spent.

You said that he took "my 2 children" not "our 2 children" so I assume that they aren't his, in which case, you need to report him for kidnapping.
