Serious situation here... I am in the process of being offered a job at a good company. They said that they are going to do a criminal background check... and if all goes well then I should be working by next monday (16th).

OK.. heres where it gets tricky. I was arrested in Dec of 2006 for shoplifitng felony (actually I was supposed to be named as an accomplise to the crime instead of as the actual shoplifter.)
I spoke with my defender and he said that most likely it can be dropped to a misdemeanor when I go and take my plea later on this month. I was wondering, when they conduct the background check on me, what will show up? I have not been convicted of a felony, because my court date has yet to come. Do you think that a "pending felony" charge will show up on my criminal check? or will it just show up as " no felonies". I have no other felonies from the past, so I was wondering that since I'm in this grey area between court dates and a job, what will come up when they do a check

If you haven't been to court for trial you haven't nothing on you. You were charged not convicted of the crime yet. Nothing can go on your record until your found gulity of the crime. I was just in your situation this past nov. but even though it may be dropped down to a misdermeanor it will appear on your report as a felony for about 2 to 3 months. So right now you have nothing to worry about good luck

It depends on what type of job you are applying for and what type of check they actually run and what types of questions were asked on the application and how you answered them as to if this may impact you now or in the future.

Many criminal background checks do just show convictions, but the more thorough ones (like ones where you would be trusted with larger sums of money, like working at a Bank, the government or children) would show all arrests.

As long as you answered everything on your application truthfully (meaning if they didn't ask specificially about any arrest, you are not obligated to tell them) you will be fine; however, if you lied and are caught, you can be terminated immediately once the lie is discovered, even years down the road and regardless how valuable of an employee you are to the company.

If you were guilty in any way in assisting with the shoplifting (or they are confident that you can beat the charge) heed your attorney's advice and plead guilty to a lesser charge. Usually a single misdeamnor on your record won't keep you from job, a felony conviction will for 7-10 years for most jobs.

I don't think you have any worries, first of all you cannot be held responsible for someone elses actions. And if it did come up, you can say that you were a witness to a crime and that you have not been convicted of any crimes. But in future remember crime does not pay, so please don't be a part in it ever,ok
