and im taking my wife back to county court(uk)to get an intrim residence order so that she can live with me because when i have her on a saturday she refuses to go back and is crying hysterical and screaming and it breaks my heart my wife can not have her because the court says her new partner is not allowed to be present because he has tried to kill himself twice will i get her back because i did something wrong about 3 weeks ago i beat the **** out of her new bloke which made me feel good its something im not proud of but no one is going to bring my kids up and she nos that

my daughter is a twin and like i said i have my boys living with me and my daughter wants to live with me and her brothers and i have always said they can see there mother when ever they want to.she had the affair with this man who is 61 and shes 34 and no hes not rich and i no its not just sex because when i saw him and hit him i said to her you left me for that and no i have never been violent to her before

Sounds more like venting as oppose to an actual question... but the one about the daughter is pretty geniune. Seems you've put yourself in quite a mess with this lady. No easy fix here seems you've neglected having a deep relationship with this lady because she really hit the ground running. Now weather she is doing this out of spite or a geniune love for this guy I can't tell I don't know enough of your guy's history. But the going violent after never being violent shows that you have a habit of hiding how you feel tell it boils over which would leave me to believe that you did alot of that during the relationship, the hiding how you feel, not the violent part. Which would mean that chances are you got stuck in an agreement more then a relationship and it finaly broke her, chances are because she didn't feel for the kids as much as you did, not good. Which would be why she is spending so much time with this guy and not her daughter... which is completely cold and unfair, but when you pick a lady who thinks it more about the relationship as oppose to the family you get this kind of stuff. Get her out of this, they say a women needs his mom, but she can do better without mom, then without a strong dad. Espacially when the formula is the way it is, she's a weak women, buddy, don't leave her to raise your daughter the same way...

Sheesh...if your away from your wife already (she is called Ex) then mentally your daughter has already gone through what ever trauma she went through the first time. I would not put your daughter through it again..and yes, it will happen again. Don't know how long you or your Ex can put on the face, but there will be a time limit where one of you says "Go to 7734". Your away from her so keep it that way! Find a way to be the best father you can and spend as much time as you can with your daughter as you can with the situation you have. You must be happy to make your daughter happy--she will be able to tell that you are not happy with her mom and that will cause her more internal misunderstanding than having her just accept that her dad and mom don't live together but they both love her. Just make sure she is not loosing time with you.

Tony,

You must go to the courts and apply for a residency order for your daughter, in fact just keep her with you at the next time she visits if she is 12 she can decide where she wants to live (gillick competence)

If you have the other children I presume you are the resident parent/ this will apply to all of the children, its not good for families to be split up like that go get your girl.

As for the assault, you may face charges if he reports you and wants to press but u can argue this is a domestic matter, I presume there was some provocation?
