That depends how and where the photo was taken. If you willingly posed for the photo, or the photo was taken in a public place, then as the copyright owner of the image, they can do what they want.
If you contracted with a photographer to take the photo and the contract states that the copyright goes to you, then they can't use it. Similarly, if they took the photo in a restroom or your home or another private place, where you have an expectation of privacy, then they can't use it without permission.

If they have taken the picture, (or use one not copyrighted), in a public place, yes.
If they take something like a school picture, which is copyrighted, or impede on your privacy to take them, then no.

You can always write an email to the person or company providing the webspace, and tell them you want it down. They will most likely remove it, rather than have a problem.

the copyright to the photo will have passed to whoever inherited your late fathers estate, unfortunately they can use the picture without your consent unless it is being used in a malicious way, in which case I would write both to the person who posted the pic (family member?) and also the site hosting the image asking for it to be removed

Yes, you can legally put a photo on the internet. However, the photo cannot be placed with the intent to do malice to the individual, i.e. you can't put photos on the net from "up the skirt" shots without premission.

I am not a lawyer but here is my understanding; first ? is who took the actual photo? Photos fall under patent rights so if YOU took the photo, then it is your property according to patent law and no one else has a right to it. Not sure if this just applies to sales or in all cases. The same goes for if you did not take the photo, then that person would have all rights to it.
