my wife screwed me over and doesnt want to file our taxes married filing jointly, which makes me due 4,000 of tax. how should i talk about this to IRS ??? can i pay it in rates ???? 100 bucks a year or so ???

Were you living with your spouse at any time during the last six months of 2006? If so, then unfortunately you will have to file a married filing separately. If you were not living with your spouse during the last six months of the year and have a child living with you, then you could file as head of household.

Do you have a higher income than your spouse? Do you have any children that you lived with for more than six months? If so, then you win the tiebreaker for claiming the children as dependents. Maybe that will help you a bit.

Other than that, you cannot force your spouse to file wth you, so file on time even if you can't pay. You can apply for an installment payment plan with the IRS, but it is an expensive way to pay them back. Better to get a loan, borrow on a credit card, etc.

Married people have the right to file joint returns, but they're not required to, they can file as married filing separately. Financially, that is rarely beneficial.

If you owe taxes and can't pay it, the IRS will set up a payment plan for you. But they're not going to let you pay just $100 a year - that would probably take about 100 years to pay it off by the time you figured in interest, fees and penalties - not going to happen.

$100 a year???? No!

$100 a month.....maybe. Remember the IRS also charges interest.
