My fiance sells Mary Kay and doesn't know if she needs an EIN # to file taxes. Does anyone sel Mary Kay and know if she needs a tax id number or does she just claim it as a hobby that earns gains?

She does not need an EIN. I am a MK consultant and I just went to my accountant on Saturday. As an independant beauty consultant you are a sole proprietor.

She only needs an EIN if she has employees working for her. Or if her business is incorporated or is a partnership with someone else.

The "12 year tax prep guru" above should know that self-employment income of more than $400 requires a return to be filed. She's probaby confused the $600 filing requirement for Form 1099 payments. Shame on her!

If you set the business up as a corporation you will need to file final EMPLOYER returns. If you were filing as an individual then just keep filing and stop reporting income that you no longer have.

If your fiance made over six hundred dollars for 2006 selling Mary Kay, then yes, she will have to file it. She can file as self-employed.
