An actor 'K' gets a LETTER from one of his female fans.She writes "i like your looks , you are very hot and sexy, i am in love with you..i want to do sex with you..tomorrow i will come to your office";sends her photo and adress to actor'K'. Next day actor'K' waits for her but she doesn't come..angrily 'K' goes to her home and rapes her. 'K' gets arrested..he shows that letter to court and tells" i must get clean-chit because lady has been given her consent and shown her will to do the sex with me''. where the 'K' is wrong? what will be the judgement and WHY?

Rape is an offence, whereas doing sex with consent is not. In this case the female fan sent a letter to 'k' for doing sex with him next day when she will come to his office, but she did not turn up, in such a case she changed her mind for this proposal which she had made & there was no acceptance to this proposal from even ‘k’. The act of 'k' was wrong as he without asking her new consent for doing sex just raped her. The previous consent for doing sex had been withdrawn by the female fan as she did not go to his office for doing sex with him. Had she continued her consent for doing sex with 'k' she would have gone to his office but her not doing so simply will be presumed her withdrawal of her consent. 'K' is guilty of rape.

I would say that since the letter that the female fan sent the actor was not a legally binding document (not signed by a notary or witnessed by others), that is where K was wrong. Second, she would have to consent at the time of the occurence. Just because she wrote in the letter that she wanted to perform the act with him doesn't mean that it holds her to that. I think that K would be charged with the crime and rightfully so. There was no legal contract or witnesses that signed the letter so he is guilty.

A woman can legally withdraw her consent at anytime, even during intercourse itself. For a man to continue constitutes rape. There is no legal point of "no return" in rape.
