'K' gives debt to a person and takes a written signed agreement from him that if after 1 year he does not give that money back.... 'K' can kill that person.After 1 year that person dose not give the money back.'K' kills him..he gets arrested. In the court ,he shows that written agreement to save him. what will be the judgement and WHY?

Under the India Contract Act, the agreement/contract itself is invalid as no agreement or contact can be made for consideration of any act which is illegal or against the public policy. To kill any one is illegal, such a consideration is illegal & hence such agreement itself is illegal & not enforceable.' K ' killed the person has committed murder & such an agreement is no defense for committing such an offence.

The offense of murder is not the victims to give up.

The state charges the person for murder not the dead person. As the state has not waived its right to charge the murderer the charges stand and the person will be convicted.

Or new case law will happen

There is no legal way to write a death into a contract and you cannot use your life to verify a debt. So that is correct, it will be murder.

It is not possible to agree to being killed....The charge will be determined by the prosecutor, but be sure of one thing...you will be prosecuted, convicted and the judge will determine your length of incarceration...
