this is his second offence for threatingwords/behavior hes already on a conditional dischrge

Almost certainly not, given how full the prisons are.

He didn't learn from his conditional discharge, did he?

To go to prison you must be sentenced to more than 231/2 months of jail. Otherwise they put you in a county jail. Even people that commit manslaughter dont get sent to prison most of the time. If he made terroristic threats,using direct intentions on harming someone, than they will probably give him a fine and community service and maybe probation. If he just used threating words but nothing direct,I doubt they would waste the time putting him through the courts. But anything is possible nowdays.Especially if he is a repeat offender.

At the end of the day what penalty he recieves for this will be up to the magistrates no one else can comment on what penalty he may recieve without knowing the full circumstances of what has happened previously. If he pleads guilty and is remorsefull this may have a bearing on what sentence he gets, but as I say the final decision will be from the magistrates so nobody can really speculate on this.

I would think that for a second offence the will get a really stiff warning from the judge possibly with a suspended sentence and if it happens again he will go to prison. He does sound rather stupid.

there is not enough info here on what he has done wrong, there is a line between harassment and assault harassment is more or less a mistamenor unless he has endangered someone, if he has crossed the line into an assault charge then he could be in trouble if he is threatening someone with violence or harm of any sort then he/she could see a little bit of prison time but on a second offense there will not be a dramatic sentence we are talking months. not years.

For a second offense it could happen depends on the conditions of his discharge. Also if it happens a third time depending on which state you live in he could be charged as a habitual offender and go back for life!

PS Since 9-11,threats and stuff like that are no longer taken ligtly.

If he is on conditional release for this type of behavior and does it again...it is obvious he has NOT learned his lesson...some jail time is coming....Sorry but it is called for...

it does depend what he has said if it is about race or death threats he has got a very chance of going to prison but if it is a threat of beating someone up then there is a very small chance of it but i don't think so
