Can I obtain a fiancee visa if my petitioner doesn't work, but his income answers poverty guidelines requirements?
My papers have been already approved.

Hello:

Just want to correct what others were saying here.

Your fiance's income for 2006 must be above 100% (not 125%, but only 100%) of the federal poverty guidelines for the certain household size.

For example, if there is only two of you (and he has no dependent), then he must be able to show income of above $ 13,200 in 2006 (if he resides in lower 48 States).

If he does not work, then a co-sponsor might be required. Or in alternative, he can show that he owns certain assets that would compensate for the lack of income from job.

Just to sort out what others have said, you need to understand that the fact that the petition was approved does not mean that a visa can be issued. The petition approval only indicates that the relationship is beleived to be genuine. Whether you qualify for a visa is a related but different issue.

That said, if your fiance's income is 125% of the poverty level for a family of that size, then you will not be refused your visa based on a fear that you might need public assistance. In addition, your fiance could ask for an I-134 (affidavit of support) from another member of his family, too, to further assure the consular officer that you will not end up on welfare.

The embassy has the discretion to issue a visa after knowing that the petitioner has money to spend for your expenses.

sure you can...anyway you aplication been already approved, because if youre not capable of having a visa then there's no reason for you to be approve....take the second steps now, guess embassy will give you instructions on what to do next.
