After I married my babys father, he pressured me into filing for his citizenship. We filed the papers with a Immigration Attorney but I was never informed on the process. SHORT STORY... I REGRET IT! I left him and moved to Phoenix, I want to know If I can divorce him from another state? I need to know what his status is and what to do with whatever. HE recently received a cash settlement from being injured on the job How can i find the amount he has and what r my rights
to it

call uscis and let them know that you want to withdrawn the petiton that you filed for him, and that you are separated, ot talk to the lawyer that helped you filed the papers.
About the money... as somebody said you got into this mess alone. He probably already sent it to his country.

Lets see here, you married someone that you knew was breaking the law, had a baby with that person, tried to get him in this country and then divorced him and moved to another state. Now all you're concened with is if you can scam the guy for a few bucks from a settlement? you are one quality individual. First off you need to contact Immagration and let them know that you are no longer married to this person and he should be picked up and deported. Next try to get your life back on track, go to work and get some basic ethics so hopefully your baby will not be brought up in this type of atmosphere.

You got yourself into a big mess, I hope you have learned something from this.
Why would you have a baby with an illegal alien?

You can contact the US dept of Immigration and find out what his status is if you are married to him, and have a copy of the marrage certificate. If you do not have a copy, get one from the clerks office of the city you were married in. You should have a copy of the babies birth certificate, if you do not have one get one. With that information, you can file for copies of his immigration information.
Go to court and file papers for child support. If you know where he is that would help.
The court can put a lien on any settlement he might recieve to deduct child support payments, or past child support, from the time you filed.
You should contact Immigration Control and Enforcement and inform them that this guy married you to get legal status.
He can lose his legal status over this, but he will get deported, and you will never be able to enforce childsupport when he is.
So you better just get a job and get on with your life supporting your child alone.
Don't hook up with any more illegal aliens, and for Gods sake use birth control!

how can an illegal get a cash settlement on a job that he wasn't suppose to have in the first place?

Your real worry has to be supporting your child. Play with an illegal, get burned.
