My dad is retired and did not work in 06. My mom worked a little bit and got unemployment benifits (she may have made over $3300). I was wondering if I can use my dad as dependent and my mom can file an individual return.

There's not quite enough information provided to answer your question accurately, but more importantly, are your parents still married? If so, your mom cannot file an "individual return". Your parents are either married filing jointly, or married filing separately. If your parents do not live with you in your home, did you pay for the home or residence in which they are living? If your father is retired, did he receive any type of pension, social security, or other payments from a retirement plan? You must consider all of these regarding dependency exemptions and the level of your parents actual income.

If they file a joint return, then no, you can't claim your dad. Otherwise if you provided over half of his support, you might be able to, but proving you paid over half of his support might be tricky if your parents are living together.

Generally not. Esp if one of yr parents files as head of household. and if your mother files as married, but filing seperate, you cannot claim your parents, esp if they are both married and one is working, and neither of them are handicapped.

If they are maried you have to file both - trust me!
