the bail call for you after they ask you for a name and number, can I sue them for this? I was in the cell and I heard him say "Beth this is so and so form the Marlboro district court, Ed needs 500 dollars for bail...etc", but then when i got out of jail finally that night my friend said she never received that call and she even checked her voice mail and there was nothing there. I'm starting to think the ahole guard did it on purpose so that I had to be sent to the jail from the courthouse before I could get bailed out. Is there anything I can do? I want to sue because by law a person should be allowed to make a "bail call" to someone while in custody and the people there should let you make that call not some stupid guard.

You have a right to make a call, but most likely at that particular time, no one knew exactly how long you would be there. You have to be processed, and your prints have to clear. Sometimes, that could be a long process. What if another warrant popped up, after you made the call?. The bond would change. Depending on your attitude, they may have just done that to calm you down, and give you some sense of relief. Either way, you have to be incarcerated, while you were being processed. By the way, if no one made a call, how did you get bonded out?.

Corrections officers are just as important as the ones who arrested you..Baliffs are Policemen, Policemens are servants to the publics need for safety...chill out..you are free..don't think a lawyer will help you with that tude ya got potner. They make it tough so you won;t enjoy it. Don't be an ahole to the guards next time..that's the job of professionals, not you. Sometimes folks think they are smart. Sometimes they are. Justice comes in all forms of humanity...Be it the criminal who wants to change, or the Officer who helps him.....with a few words of wisdom. Good Luck

First and foremost...you've made it clear this person was NOT the police but either a baliff from the court or a corrections officer. So when a story such as this goes out...don't point the finger at the wrong person.

As for the question concerning if you have a lawsuit. You haven't indicated whether or not YOU made a telephone call after being incarcerated or during incarceration to a bonding company.

It's not the responsibility of the correctional officer, court, or police to do that for you...it's yours!

YOU have a right to make ONE phone call. Who YOU chose to call is up to you. It is up to YOU to make a bail call, not the responsibility of jail staff. In the future if you don't want to have to worry about bail I suggest you stay out of trouble.

I'd see a good lawyer, as cops are pretty much a;holes everywhere. I was under the impression that the law allowed you at least one phone call [that means you, not a screw]. Good luck.
