Many creditors do not wish to go to court since they will incur expenses and legal fees. If you can make some sort of payment agreement or settlement offer prior to it reaching court, you may be able to reduce the amount in return for payment.

I am pretty sure that if you owe any company money, they can go to court and it can be ordered that you pay or, that your check be garnished!

Anything can be garnished if it's taken to court and they get a favorable judgment.
