We are in the process of getting to court to get primary custody. CPS is in the middle of their 5th investigation my step son who lives in a bad situation with his mom. Each time CPS comes she puts on a show. He has been removed before however. His mom will not him call his dad, me or his siblings, and won't answer his dad's cal. We only see him on our standard visits. Once he snuck a call while his stepdad was sleeping, whispered the whole time and said their fighting scares him. My husband said if he feels he is in danger call 911. Apparently step dad was listening in and later him and his mom forbid him from calling 911 and he got in trouble for talking to us. Also he got in trouble for telling CPS the truth about things at their home. We have to take him back Sunday, he is scared to go. Our atty in out of town till MOnday, we are scared of taking him back. It seems like it should almost be illegal to forbid your child from 911, is it? Must we return him?

It is NOT illegal to tell someone they can't call 911.... As for the rest of your story, talk to an attorney, not strangers on the internet.

It is illegal for parents to tell their kids not to call 911. When the caseworker speak to the kid in private and NOT tell the other parents what was talked about? The kid could say they, take him away if he talked about it or if the parents threatened to make him. It was just "law" stuff.

Another thought. If he has enough money to get to your place every time they take him home - height-tail it out of there and get to you place every time.

Always give him back, of course, but as soon as he gets back, run away again. Eventually they will see it is impossible to keep the kid at home and must think up other alternatives.

Have him start showing up as homeless shelters or camping around the school yard or teachers houses or police and fire stations. The kid should always be nice to those people, just explain he is afraid of the parents and he won't spend another night there.

(My really uninformed opinion.)

If he thinks there is a problem he should call 911, especially in that situation. It is not illegal for him to be told not to, but that doesn't look like good parenting, given the current circumstances that you have explained.

unfortunatly you have to return him, we were in that situation, tell the case worker and write everything down your stepson tells you even the smallest things, good luck to you, it took us 7 years to get my stepson away from where he was living
