dr from ms wrote out rx very medically neccssary for 57 year old to have a pool built she has seizures and cannot drive so this is her phsyical therapy the pool is 4 ft and 5 ft on each side and

Maybe, but NO ONE else can ever use the pool or you lose the deduction.

Yes you can. Its not like the pool was built for several people to swim in, but obviously, by the size, its easy to see its for therapy. Give it a try and stick to your guns.. the IRS gets stupid about things like this. Oh, and there are court cases that have set a precedent on theraputic pools.

If it increases the value of your home, then you could only deduct the portion that's above the increase. I'd guess that a pool that size would not increase the value of the home, so as long as the doc prescribed it as medically necessary, you could deduct it as a medical expense. Medical expenses can only be deducted if you itemize, and only the portion of the medical expenses over 7.5% of your AGI may be deducted.

I read the IRS lost on this one when they challenged the deduction in another case.
