I am holding H1-b visa since 2005. I was in student visa fron 2003 to 2004.My parents visted me in 2004-2005 and stayed with me for 6 months and went back to india(indian citizens ) . Their income is less than $3000.Can i claim them as my dependents for the tax file of year 2006 ?

To claim anyone as a dependent, they must pass the 'Residence Test' quoted below:

Was your qualifying relative a U.S. citizen, U.S. national,
U.S. resident alien, or a resident of Canada or Mexico?

It doesn't sound like they pass this test. See page 20 of the 1040 instructions for more details.

Your mom cannot claim you anymore unless you are a full time student... since your gross income exceeds the allowable amount. If she does, you might be inviting an IRS audit letter. File your own taxes. Email me on my site for more info. Insurance will be affected as far as I know. S.Khanna, EA

Did they spend at least 31 days in the US during 2006 and do you provide more than half their support? If so, possibly, if not, no, you cannot claim them.
