Ok, We are a small machine shop in CA and was thinking of buying a used grinding machine off of e-bay. The machine is in another state (WI) do we have to pay the sales tax for that item. If we do, is it CA sales tax or WI sales tax?

Hello, surfer girl! You will owe CA use tax if your WI sales tax is any less than the computed use tax on the item. For example, if you were charged 6.95% WI sales tax and your local CA use tax is 8%, you would owe the extra 1.05% to CA.

You would pay California "Use" tax.

You would not pay it to the vendor. You would pay it directly to the state.

Line 2 on the California Sales Tax Return: "Purchases Subject to Use Tax".
