According to credit report, credit card account was charged off in Nov of 2000. Michigan SOL is 6 yrs so that was up in Nov of 2006. Status details on credit report states scheduled to continue until May of 2007. Caller ID shows actual credit card (Am Expres) company is now calling. Considering this debt has ruined my credit for 6 plus yrs already and it's going to go off my report in a month or so...any advice as to what I legally have to do? I can avoid picking up the phone for a while but that too gets old. Anyone have this problem and how did you deal with it.
Signed..actually not a loser but this is one debt of many (all of which I have paid after losing my job) that is too large to tackle

Order your reports, if you haven't yet, and see if only AmEx is reporting or if a collection agency is reporting also.

The link that Smoovy listed does have a link to a SOL letter.
If you use that letter to AmEx, you will have to remove the FDCPA references since original creditors are not bound to the FDCPA. You would have to add in your states SOL statutes.
If a collection agency is reporting the debt, you would keep the FDCPA references along with adding your states SOL statutes.

You might also check out the SOL letter in the link I've listed.
Again, you will have to revise it if you are only dealing with the original creditor.

Send everything certified mail return receipt.

After you get the green card back from sending the letter, you might dispute the trade line as obsolete.
Since it is due to fall off in May, they usually won't delete (an undisputed trade line) until the end of that month
Sometimes it may fall off early with a dispute, sometimes it will be verified and remain until the last possible moment.
