This is the first time I have received anything regarding this 12 year old debt. It is not on my credit report and never has been. Also I do not remember making this charge from Fingerhut. It just seem like the collection agencie picked the first name like mine that amtched. Do I owe this debt being so long ago? Also how do I contest this so it does not go on my credit report since I did'nt do the charge?

Do everything in writing !!!

Order your credit reports to make sure they have not already placed anything on them.

Since you don't recognize the debt, it could be possible that they did exactly what you mentioned, just picked a name that comes close to the original debtors.

While it may seem that the debt would be out of the collecting SOL for "every" state, that could(?) be the date that account had been opened and it actually was defaulted on later than 1995.

To be safe, send them a debt validation letter. Make them prove that it is your account.
Send it certified mail return receipt - create a paper trail.

Since you had just received their letter, they MUST give you 30 days to respond before they continue collections.
When you send a debt validation letter, they must "properly" validate the debt before they continue collections. Proper validation must come from the files of the "original creditor" and not just a piece of paper or a computer print out from the junk debt buyer.

Putting anything on your credit report "is" continued collections. If they add it to your reports within this first 30 days or during the validation period, they are violating your rights and you have a legal right to sue them for up to $1000.
Also, phone calls, dunning letters and suing is continued collections - and actionable offenses if you wish to persue it.

If they make a lame attempt at validation, or do any of the violations I listed above, file complaints with the BBB, FTC and your and their AG's.

Call them and tell them that they have the wrong person - If they argue tell them they need to prove it to you.....

Chances are someone sold your old debt to them.....
