hell yeah especially if its that recent dog food problem sue the hell out of them for not being careful

If the product has been recalled, I don't think so. And even if your case will be presented, chances are...you aren't going to win because of the recall despite the fact that they recalled before the dog's death, causing the death of the dog to be preventable. But still it doesn't hurt to try. And make sure you have proof. The food, the bag etc. That's why the dog food distributing companies always recall to warn dog owners not to feed their dog (s) the poisoned substance. They try to avoid thousands of lawsuits that can eventually get them bankrupt. But if the product hasn't been recalled and you have concrete proof that the product was contaminated with a foreign substance, not authorized as an ingredient in the food, and resulted in the dog's death, you got a case. Get more information from a lawyer and a veterinarian. Even if you can't sue. Some of those recalling companies may be willing to generously compensate for your loss.

You can always sue but winning is another story. Who do you sue? The dog food companies that buy from another company who label it for them, the manufacturer who uses ingredients that are not normally tested, or the source of the ingredient in China? Don't forget it may cost thousands to sue with all the proof you would need. There are class actions suits starting but even they may have trouble proving responsibility and cause.

The laws consider pets as property. Yes, you can sue but the cash value of the pet as PROPERTY will generally be less than the cost of the legal fee you will incur. Americans consider their pets as a member of the family - a loved one but the law generally considers animals as property. Now if your animal had special value such as a show dog or a rare purebred that you use to sell their puppies, you could show the animal had a higher cash value. Things such as a loss of loved one or emotional attachments don't really work here because the animal is just property. The best bet would be a class action suit but there are some hurdles here if the owners chose to go that route. So yes, you can attempt to sue but you chances of getting a high cash return are very limited.

posiened food like canned food? I would, you can sue anyone for anything. Do you still have the food? They will need a sample, of the food. And they will need to run tests on the dog, to figure out exactly what happened. Call the police and ask them how you would go about doing that, or better yet go to a lawyers office and ask them. They should be able to tell you what you can do.

There is at least one class action lawsuit that's being started.

Unfortunately, right now the law is set up that pets are property so you are only entitled to replacement cost. That means that if you got your kitty or dog for free, or you don't have a receipt, you could get zip, zero, zilch.

I believe that menu foods is willing to reimburse for vet treatment, but you'd better believe that they won't just be handing out money. You'll need receipts, cans, and wrappers from the tainted food and your vet will probably have to jump through hoops.

I'm just so glad that I feed a high quality food so that this isn't affecting my animals.

You can sue, but that doesn't mean you'll win. There are some of us whose pets died weeks before the recall.

I didn't keep any dog food containers, receipts, etc. because my dog died in early Feb. No one knew of the recall until sometime in March. My vet that cared for my dog while he was sick is not very encouraging or supportive of me either.

IMO, some will recover their vet bills easily. For some of us, whose case will be harder to prove, that's another story. I'm still investigating...

Yes u can sue. Alot of people have and are already, esp. those whose animals have passed on cuz of the food, but u would have to prove through your vet that it was the food that caused the death. Sorry to hear about your animal. I've animals myself and they are like my chldren. Good luck

You can try and you will probably win but it will just offset the costs to sue if not cost you more. In this case the FDA is the one who F'd up when it came to the dealy in the recall.

Yes. Infact if you are reffering to the recent episode that has been all over the internet, I believe there is a class action suit in the makings.

That was just so sad. All those people losing their pets.

it depends
if it was the recalled food then yes you have a major case but was it cause of someone doing this to your dog, if so im not sure but you would think yes. alot of people consider their animals as a part of the family i would call a lawyer
