My appartment has no handicap parking, and when I asked about it they said I would need a written letter from a doctor (which wouldnt be hard) and also if they put a handicap parking spot, that I would lose my garage. Because only one spot per person is allowed. This seems unfair, any answers???

Yeah I'm handiecap, and both my wife and I have trucks. Trucks that don't fit very well in their garages. Plus having them make a handicap parking spot, doesn't insure that it would be mine alone, it would be for anyone who is disabled (which I have NO problem with at all) so how can they state that it is reserved just for me, usless it has my name on it. Plus every appartment gets a garage, so to me that is a mute point. I feel sorry for any renter who has to get around using a wheel chair, I personally can get by using a cain. I do like the idea from the guy suggesting the use of a spray can. Almost sounds like we are related.

I would take it to the city for a complaint and see who you need to talk to there. You have rights don't let them take them away...Good Luck.

well for everyone that said are you handicapped he said, and i quote, "they said i would need a written letter from a docter (WHICH WOULDN'T BE HARD)" So apparantly he is handicapped. I would go back to them again with the letter and tell them you would like a handicapped spot and also your garage, and when they say no tell them "You'll be hearing from my lawyer" or "Be expecting a call from my lawyer" as you walk out. Don't really need a lawyer or anything but in most cases this will work. We've used it many times when people just refuse to do anything at all to refund our money for something, or once with our landlord because our house we were renting was in such bad shape and he said he was going to sue us if we didn't pay the rent because we said we wouldn't until he fixed the phonelines and dishwasher and power outages (quite frequently 2-3 times a month and it's just our house). And he said he wouldn't so we said you'll be hearing from our lawyer, and he said nevermind he won't do anything and when we move out he will give us back our deposit the day we vacate. So this could work for your problem also depending on if the apartment wants a lawyer sniffing around.


However I can't say that it is unfair in anyway. Why would you need two parking spots for one car? Is it that sometimes you want to park in the garage and sometimes in the handicapped space, or is it that you store things in the garage? If you need the handicapped space then go for it, but I don't see the need for both of them, unless you're thinking that someone might park in "your spot" if it's handicapped.

That's discrimination against the handicapped. I would go buy a can of spray paint, take a picture of the handicap icon at the store, then wait til after dark & spray-paint the icon in a parking spot that should be handicapped. When they come & ask me if I did it, I would say "Who, me ? I would never do a thing like that!" I doubt if they will paint over it, so at least you'll be able to use it part of the time. (You're probably not the only one who needs a handicap parking place). It would be easier to get a letter from your Dr.

you have a garage and still need a handicap spot? hmmmm, I assume it's because your garage is too far away? and if that is the case, why would you require a garage at all if you had a handicap space? I know, storage, well, the apartment complex isn't in the business of storage are they? Seems to me perfectly reasonable that if you have a handicap spot, you don't need a garage, and if you have things stored in it, you can always have that stuff put into a storage facility. We cannot all have our cake and eat it too.

You would have to discuss the matters with the ADA. http://www.usdoj.gov/crt/ada/adahom1.htm
If there is a complaint about the parking then ADA will come in and do a site survey and get the ball rolling on changes.
If your garage is not Handicapped and there is no way to modify it, then your best choice would be the parking spot.

1) The number of handicapped parking spaces depends on the total number of parking spaces in the whole lot.

2) However, if the parking lot has not be updated since the Americans with Disabilities Act came about in (I think) 1989 or 1990, then they don't have to have any.

3) Get on line and look over the ADA, then call your local chapter, there should be one near you or in the closest big city and get their advice.

By law they have to give you a handicapped parking spot. But if you have a garage why do you need it?

It's one or the other. I am sure in your lease it will tell you one spot per apartment/tenant.

Why would you need two places to park one car?

Get in touch with your local officials. I'm sure they don't want to be on the news, or in the newspaper. Talk with an attorney and get some information from them. It's up to your local government to install handicap parking. In some states, it's a violation to not have them.

My understanding is that the parking spaces/handicapp is totally put there by the property owners and not law enforcement. I would give them the letter from the dr. if you could and if they didn't produce it ASAP I would mention the idea that you could contact a lawyer. That should get them moving and stop beating around the bush.

you cant you parked the place you werent allowed to park your boned handicap parking is often of course marked with signs and indicators and blue strains get your head out of your rear and study to pay interest
