My wife and I are separated and are filing "Married Filing Separately" (Her choice). If in the future, if I want to "revisit" my 2006 taxes, can we refile those taxes under "Married Filing Jointly?" If so, how long do we have to do that?

Thanks!

Hello, Kevin! You can file Form 1040X within three years of the original due date of the two separate returns in order to combine them in a single joint return.

If you think the filing status might shift year by year, be aware that if you originally file as joint, you cannot go back and amend it as separate returns except when one spouse has passed away.

The time limit is 3 years. Unless your wife agrees to a joint return, you can't change to 'Married Filing Jointly' status. She would still have to sign the joint return.

You have three years to amend your return from married filing separately to a joint return.

You can't amend a return and go in the other direction, from a joint return to separate.

Yes, but you cannot change from MFJ to MFS. You have 3 years just like with any other amended return.
