Only if they aren't using bluetooth or a handsfree headset. A handsfree headset is like $30, and well worth the satisfaction of knowing that you aren't compromising your and everyone around you's safety. But yes, without either of those then it shoud be.

Oh no doubt about it should be Illegal kuz to many people get injured especially pedestrians get killed by cell phones and i watch tv and they show commercials for that it says when ur driving and your cell phone is ringing let it ring and dont pick it up kuz it can be an extraction but hey people do it anyways.. but i lived in another part of Oregon and any driver that got caught talking on the cell would get a big Fine and even sentenced to jail

Driving whiel distracted is a problem, butt eh cell phone is as dangerous as lipstick, or a big mac, there needs to be an all inclusive driving while distracted regulation some people multitask well, others have a hard time using the controls of the car without any distraction.. would just be a hard to enforce law though since it would emcompass so much

Just watch people. When on the cell phone, they stop early, they stop late, they start early, they start late at red lights. They wander about in the lane, they drive slow, they drive fast, and really have little clue what is going on around them. They all think they can multi-task. They should be forced to watch video of themselves. Yes, it should be illegal to talk on the cell-phone while driving.

I think TOO MANY people drive as though driving isn't the first concern......they do it on autopilot and this is why there are SO many accidents.
I try NOT to use the phone while driving, but when I do....
I use a headset.
I think making it illegal could be a good idea, but its not going to stop people making other things important
while driving.......look at all the tv's in cars, the women putting on makeup, people eating, etc.

I believe that it is a matter of personal responsibility, but I do understand the view point of those who disagree with me.
My dilemna is: "Where do we stop legislating?"
If talking on the cell phone is illegal; then how about the following:
Applying make-up, eating, drinking, looking away from the road (for whatever reason)......
I'll be the first to say that I don't like to see a person in my rear view mirror who is peeping over the steering wheel of their giant SUV while applying make-up, screaming at their kids, eating breakfast and talking to their friend on the cell phone- all at the same time!!!!!

even though some of us have been driving so long it seems like 2nd nature to us but the fact is when we drive we already have enough things to do that adding one more thing to do that has nothing to do with operating a vehicle safely is too much of a distraction. almost everytime i have witnessed someone operating a vehicle and talking on a cell phone that driver seems to be only aware of the phone call and the vehicle they are driving but thats not enough. drivers need to be aware of pedestrians, bike riders, other vehicles, the speed traffic is going at, etc....so yes i firmly believe it needs to be illegal.

Yes, starting with truck drivers. I see more and more of these guys weaving around with a cell phone planted in their ear, running over the lines and the turn signal not cancelled. It'll take a few more tragedies before "just the right person" gets killed, then maybe something will happen.

IN some states it is illegal. If you have the phone stuck in your ear and you are holding it. You are supposed to pull over to the side of the road. Yeah, I've had some women on the phone pull right out in front of me and they never saw me. I drive a 4X4 pick up truck. So if she couldn't see my truck then she shouldn't be driving. Luckily I got stopped before I hit her. You should have seen her eyeballs, they got big quick.
