I'm in Real Estate. I worker for a builder as an employee. I use my vehicle and personal cell phone as a requirement of my job.

Employee business expenses are deducted on schedule A, and are only deductible for the amount by which they exceed 2% of your AGI, and only if you itemize.

Unless your cell phone is claimed by the company you can't claim it, as well as your business miles. Only if you are self employed, you can. If you work for a Construction Company , and that person claims you, you can ask them to claim your cell and your miles, but if they do that they have to claim the vehichle you drive as well. It is very complicated to get into all that and you are better off going to a Tax Proffessional,but you really can't claim that unless you are self employed. Your cell phone, you are asked at HR Block if you have a cell phone because this year they took to much out for taxes so you get about $30 back into your refund.

Good Luck, but I am positive you cannot, Your Employer has to claim it.

To be able to get a your credits for work, gas, cell phones.
You are going to have to use the long form as it is more detailed so you can claim all your deductions.

Form 2106 and Schedule A.

You must itemize to get any tax benefit.
