in 15 years never received a ticket....today i received a ticket for supposedly going 16 miles over the speed limit. when i returned home to inspect the ticket, i noticed the officer incorrectly wrote the wrong month (he wrote march instead of april). i am responsibile within 10 days the date of the ticket. according to the ticket's date, i am already 20 days past due. i called the station and was given a "don't worry about it" response. my wife believes that because of the error, as a legal document it should be voided and thrown out. i am thinking of showing up to court and explaining this. do i have a good argument?

You could get it thrown out, but the officer can issue another citation with the correct info on it. I would use it as a bargaining chip to get a lower fine.

Most likely not! Courts consider minor errors that can occur such as a change in the year or month.

If the officer appears in court, which he should do if you decline to pay the fine, he will provide testimoney to verbally correct the issue.

What I normally say in these forums, based upon your comment "i received a ticket for supposedly going 16 miles over the speed limit", is look deep within yourself and ask if you were speeding. If you answer honestly, I'd suggest you pay the fine.

You may however contact the court and request the MPH be lowered so as not to get hit with releckless driving. If you never have had a ticket it is likely that the officer will reduce it to a lessor well just plan speeding charge and you can pay that fine.

That is likely your best outcome.

It is a great idea to go to court anyway, by going you automatically get the fine reduced, becasue your "bail" is included in that fine. You may want to bring it up in court, mayby tell them you would like an updated copy for your insurance records and see if they decide to throw it out, but I would'nt press them and ask them to throw it out, or try to present a case against the ticket.

Don't waste the courts time and the tax payers money. You were speeding. Pay the ticket.

This is a common error, and the court understands this. The citation would be amended in court. It has no bearing on the violation.

Not on your life can you get the ticket thrown out, but you can argue your point with the judge.

U could pay good $$$ to a scumbag lawyer, who might make something happen for you, but you would be better off talking to the judge..(unless his 'roids are acting up)

your wife has a very good point. fight it out in court. if you get out of this one. don't speed again.
