Does an emancipated child who left home and goes away to school entitled to child support.?

Step daughter left her mothers home to go and live with her boyfriend. My husband took her to court to stop child support and won. The judge declared her to be emancipated. This was bag in Aug/Sept. She applied to school and was accepted. She now lives on campus. Her mother just petitioned for child support. Can she do that?

She can ask for anything... but that does not mean that she will prevail.

She can try, but it is not highly likely she would be awarded as the girl has already been legally emancipated in the eyes of the Court.

What my come in to place is if there was a provision per the original divorce decree for your husband and his ex-wife to pay as percentage or dollar amount toward the daughter's continuing education (usually up to age 22), such as tuition and books, he may still end up having to pay that (but not living expenses).

If that is the grounds for the mother's suit, then you are in for another Court battle unless he, the mother and the daughter can work out an agreement.

Another thing to keep in mind is if the daughter any financial aid/loan package/grants and it was based on her being emancipated, then her mother trying to undo an emancipation could seriously screw up the formula.

No. The judges decision is final. If your step daughter has been declared legally emancipated by a judge, then her mother's petition will be in vain. Your step-daughter has to live at home to be entitled to child support.

You should contact the court which ordered her emancipation. I believe that once emancipated there is no going back to be dependent. If your step daughter was on her own and self supporting for that many months I believe your husband would have a good basis for an objection. Good luck and God Bless.
