Anyone whose name is on the mortgage can take the deduction. You must be legally obligated for the payments to be able to claim the deduction. If 2 people are on the mortgage they can split the deduction any way they wish.

1 person normally has thier social sec # on the mortgage. That is the 1. Can not alternate though may be able to share if written right.
