If your spouse is a US citizen or lawful permanent resident he must have or get a SSN for you to file your return. It's too late to do that by the filing deadline now so you'll either have to file a Form 4868 Extension and pay any estimated tax due and then file your return when his SS card arrives.
If your spouse is a non-resident alien he will need to file Form W-7 to get an ITIN if you wish to file a joint return. Your can attach the Form W-7 to your joint return. If you file a joint return with the Form W-7 attached, mail it to the Austin, TX service center, not Philadelphia as stated on the form. Alternatively you can file as Married Filing Separately and write "Non-resident alien" where his SSN would go.
To file a joint return he will have to agree to be taxed by the US on his world wide income. You'll need to attach a statement, signed by both of you, attesting to that fact, to every joint return that you file.

Does your spouse have an ITIN or any other type of identifying number? If not then you should apply for a SSN and get your taxes filed by April 17th this year or apply for an extension to file your taxes. I suggest you see a tax preparer at Instant Tax Service!!!

If your 'spouse' does not have a Social Security number, then you cannot file as married, neither can you file as a Head of household. you can can only file as head of household if you have other dependents apart from your 'spouse'. best way to go is just file as single, until your spouse gets his Social security number.

Your spouse HAS to have a social security number - what is the reason? He/she needs to go get one pronto - how is he/she holding a job without one? I would talk directly to a tax person - try H&R Block.

he needs something there..if you owe money you have untill 4/17/06 if you dont you can file next year or anytime during the year...call the irs and ask them they will let you know dont waist your money @ h&r block..chill
