My brother and his girlfriend just had a baby about 5 months ago. But now they're going through some trouble and she doesn't want to let him see the baby. The thing is that he had to go to work when they brought papers to sign at the hospital and right after he left the hospital was when his girlfriend signed them, but she didn't put his name on the birth certificate. Could she have put his name on it even though he wasn't there or did he need to be there? Because she is claiming she couldn't. But I think she is doing it on purpose so he won't have any rights over the baby. What can my brother do?

In the state I live in, he does have to be present unless the couple is married. My boyfriend was present at our sons birth and in order to be put on the birth certificate he had to sign an "acknowledgment of paternity" document.

The father does not need to be present to have his name on the birth certificate when the child is born. She is not telling the truth about that. Is your brother paying child support? If yes, then that means somewhere paternity was established whether his name is on the birth certificate or not. If he is not paying child support and has no proof he is the father, he needs to get it in order to see the child. Once paternity is established, he can have his name added to the birth certificate. I suggest he gets a lawyer or a Friend of the Court representative and start proceedings now.

Whether he was there or not, his name should have been put on the birth certificate, he can go to the courts and demand a paternity test to prove that he is the father and then have visitation set up. Once the court sets up visitation she cannot say she won't let him see the baby. Also the courts can make her correct the birth certificate to have his name put on it.

Take her to court and get ordered visitation, custody and have his name put on the birth certificate. Maybe a paternity test should be done. Perhaps there is a reason she's not putting his name on the birth certificate.

Well the state that I live in is that your cant put the fathers name on the certificate unless they were married..That's the law here anyways..As for the rights for the baby that wont make a difference or not if he has his name on the paper..If he is really the father then he has all the rights to child as she does..

Get a D.N.A. test done and take it to court.
