i have been on probation now for 4.9 yrs and have 3mths left and just got a dirty drop ( i know im a retard) but my p.o. revoked me and i have a 10 yr back up. am i going to jail or not i have a court date on the 12th of april . this has been my only violation, this sucks

I would hope the judge is kind and takes into consideration that you've behaved for the most part.
However, to quote YOU...."i know im a retard"...you only had 3 months to go!!
The PO's word is not final...that's up to the judge. Remember judges are mostly fair and impartial.
Quit doin the "drop" and get your life together!

I will assume you mean by dirty drop you mean your uranalysis came back hot. If you have had that much time on probation, you may or may not get come back time. It is dependant on the charges you had, the social history with the court and your standing in the community. Y ou may get a bit of weekend time if you just cop to it and say you were stupid and made a mistake. Your court date is only to hear charges as to why you should not get come back time. If you have a good record with the PO and the court since and you have no other violations it is highly unlikely you will. However the judge may make you do a weekend or two to refresh your memory as punishment.
Call the commonwealth or DA's office for your jurisdiction as well as your PO and work out a deal. Let em know your were stupid and you want to do the right thing. They may work with you.

:You say that you have been on probation for 4.9 of 5 years, and your officer has submitted a petition to revoke your probation due to one dirty drug test. I really don't believe that. If I violated everyone of my probationers who flunked one drug test, I would be laughed out of court, and probably looking for another job.
The jails are too full.
If what you say is true, then, by all means, ask for a hearing before a judge. Go to court clean, and bring witnesses that you have been clean. Preferably not family. Coworkers?

Don't talk to the cops!! All they want you to do is hang yourself. Go to court and listen, and talk to the judge. Hire an attorney if need be. Be respectful, but don't ever believe one word a cop tells you. They are unable to speak the truth.
