The reasoning is that they keep your license to insure that you either pay a fine or show up at court.

But does the state of Missouri, for instance, who issued the license, give them that right?.

The answer from the first blogger is inaccurate.

First, and foremost, your license is the property of the state. The state has the ability to seize the license if there is a violation at hand.

Secondly, many states require that a license be "posted" in lieu of bond. Other states only require a signature.

DUI cases are one circumstance in my own state and in Missouri where the license will be seized as a temporary "restriction" pending court adjudication.

In Missouri, after a person has been read the implied consent notice, been tested, or refused the test, the police officer will keep his or her plastic driver's license. He must serve the person with a yellow form entitled "Notice of Suspension/Revocation of Your Driving Privileges" that has been properly filled out by the officer. This form will serve as the person's driver's license during the pendency of the administrative suit.

If you are uncertain of the actions by this officer, contact your local police agency, state police, or the District Attorneys Office in your area.

I'm not trying to start anything but the other people who answered this question is wrong. There are certain situations where they can take your license from you. If you want to find out, go to your loccal police station and ask.

The police do not need a court order to seize your license. Whenever the law or the court allows it then they can do it.

In my state they are seized for driving under suspension or driving under the influence.

That's the law. You could always post a cash bond so you could keep the license in your possession.

Police officers do not have the right to confiscate your license unless they have a court order to do so.

no they can't, even if you are arrested for DUI you still keep it, even if it's suspended you still keep it because it's your form of ID
