If there is a copyright attached to the photo, the answer is no unless you get hold of the publisher and get permission to use the photo.
Being a bakery, why dont they just take their own picture of their own cake?

It's up to the shop, but as long as no money is changing hands for the cake, it's not a legal issue.

As long as they dont advertise it then they can get away with it.
They usually do it on special occasions. Once in a while when asked, but they dont advertise doing it.
