Can I claim my bf to be as a dependant of mine? He lives with me and he has proof that he has been living with me for over a year. Hes 19 and a full time student. I read the requirements but the only one I dont meet is the relative part.

A "qualifying relative" does not have to be actually related by blood or marriage for you to claim them, as long as they live with you all year, you provide over half of their support, their gross income is under $3300 for the year, and they can't be claimed as a qualifying child by anyone else.

You can't, though, use him as a qualifying person to file as head of household - the person above who said you can is WRONG.

You can claim him as a dependent if:

1. He is not the qualifying child of another taxpayer. If his parents can claim him, you cannot.

2. He lived with you for the entire year.

3. Your relationship isn't against local law. If there is a law or ordinance against cohabitation, even if it isn't enforced, the exemption will be denied.

4. He had less than $3,300 in gross income.

5. You provided more than 1/2 of his support.

He does not need to be related to you to be your "qualifying relative" under the IR code.

yes you can, he does not need to be a relative before he can be a dependent of yours, just make sure his parents have not claimed him on their tax return. and best way to go is file as a Head of Household.
