Why? Because, let's see:
1. The BABY has a heartbeat.
2. The baby has brain waves.
3. The baby has his or her own blood type.
4. The baby has his or her own DNA, separate from the mother.
5. The baby's sex is already determined, even though it might not be known.

There are no biological differences between a "fetus" 7 months after conception and a "child" that was born premature 7 months after conception.
If the law does not treat the two individuals the same, the law needs to be changed.

Well, I'm gonna give my same answer all over again, since I *did* answer the question as you've rephrased it. ;-)
Consider that my daughters had these characteristics long before they were born:
1. They had personal tastes in music, as evidenced by their movement in response to (and in time with) the music we played.
2. They woke and slept on their own cycle independently of their mother.
3. Their mother's taste in food changed during each pregnancy. After each child was born, her mother's taste reverted to what it had been before, but the child retained the tastes the mother had during pregnancy. In other words, my daughters had food preferences prior to birth.
I could list other things, but this is *plenty* to convince me that they were already persons before they were born.

does a fetus have consciousness?
can you have a conversation with a fetus?
can you chill out and have a beer with a fetus?
do fetuses bathe?
could you play catch with a fetus?
can a fetus get a job?
can they do anything a person can do except technically be alive? they dont even breathe.
