My husband and i are getting divorced and he is leaving country and he is going to give up his rights and give me full custody does a paper just need notorized for this?

No - you need to make sure that you have a COURT OF LAW give you full custody. File for divorce and then he could answer and file an affidavit / answer giving you custody. DO not do it any other way. A notarized document just means the person that signed it was that person- it has no magical base in law.

No way. You can have full custody without him terminating his rights. but to terminate it must go to court and most states will not allow termination without another father to adopt them and assume responsibility. Unless there is some real serious reason why they should be terminated. And just wanting him to go away and give you full custody is not a serious enough reason. The government believes a child is entitled to have a legal father. Besides, if you end up on welfare (food stamps, medical, etc) then they need a father to go to for child support. And if he terminates then the child is not entitled to an inheritance from the terminated parents family.

Termination of parental rights is a court hearing with all parties present. I don't know of any other way this can be done. The process may change in some states but I have never heard of parental rights termination outside of a court.
