Yes it is illegal to have an open container in your vehicle period dot end of story!
However, the police should not be searching your trunk for a routine traffic stop. SO keep your mouth shut about it, be polite and do not open your trunk with out them having a warrant.

in most jurisdictions, alcohol/open containers are perfectly legal in the trunk of a vehicle. items secured in the trunk are not considered to be "on or about your person" as long as you are not a minor as defined by your states statutes, you should be o.k. i highly recommend that you verify this information with your local authorities.

It depends on what state you are in. Where I live an open container anywhere in the vehicle is illegal. I have even heard of people being in trouble for cleaning up bear cans along the highway.

Keep it in a paper bag and as long as you can't reach into the trunk from the inner part of the car the cops can't hold you responsible for it....

you can have cases of unopened alcohol in your car - it doens't even have to be in your trunk.
