It probably depends on the law of your state but in my state, the accused who is mentally incompetent is innocent 'til the patient has mental compentency. IOW, until the patient is able to function normally mentally, the patient doesnt have the mental stuff to be in court.
So until that point, that person is a patient - not a prisoner. When the patient reaches that point then the court will determine if the crime was committed. If not then the patient is free to go. If found guilty then the patient is now a prisoner.

Under the new Patriot Act, anyone can be held indefinitely without being charged. (See Guantanamo)
Since 2001 over 3000 people have been held and most uncharged.
If you check the act it list HUNDREDS of reasons your rights can be suspended. Anyone can be labeled a threat.
They could pick you up now with NO evidence and no judges order.
